Budgetly 14-Day Free Trial – Terms & Conditions
These Free Trial Terms & Conditions ("Free Trial Terms") govern participation in the Budgetly 14-day free trial offer ("Free Trial"). By signing up for the Free Trial, you agree to these Free Trial Terms in addition to Budgetly’s general Terms of Service and Privacy Policy.
If there is any inconsistency, these Free Trial Terms apply to the Free Trial only.
1. Eligibility
1.1 The Free Trial is available to new business customers of Budgetly only.
1.2 The Free Trial is available to Australian-registered businesses only.
1.3 Budgetly reserves the right to determine eligibility at its sole discretion.
1.4 Only one Free Trial is permitted per business entity (including related entities), unless otherwise approved by Budgetly in writing.
2. Free Trial Period
2.1 The Free Trial begins on the date you complete the Free Trial registration form.
2.2 The Free Trial lasts for fourteen (14) consecutive calendar days.
2.3 The Free Trial will automatically expire at 11:59pm (AEST/AEDT) on the 14th day unless you upgrade to a paid subscription.
2.4 Budgetly reserves the right to modify or withdraw the Free Trial offer at any time.
3. Access During Free Trial
3.1 During the Free Trial, you will receive limited access to the Budgetly platform.
3.2 Free Trial access includes the ability to:
- Access the Budgetly interface
- Create and configure budgets
- Add users and assign roles
- Explore platform functionality as made available by Budgetly
3.3 The Free Trial does not include:
- Issuance of Budgetly business cards
- Access to live transaction processing
- Payment functionality
- Banking or financial services
- Any feature expressly designated as paid functionality
3.4 Budgetly may modify the features available in the Free Trial at its discretion.
4. No Fees During Trial
4.1 No subscription fees are payable during the 14-day Free Trial.
4.2 You are not required to provide payment details to access the Free Trial (unless otherwise stated).
4.3 You will not be automatically charged at the end of the Free Trial unless you actively select and agree to a paid subscription plan.
5. Upgrade to Paid Subscription
5.1 To continue using Budgetly beyond the Free Trial period, you must select a paid subscription plan and agree to the applicable commercial terms.
5.2 Upon upgrading:
- Full platform functionality will be activated (subject to plan type)
- Cards and financial features may be issued subject to separate approval and compliance processes
- Additional onboarding and verification requirements may apply
5.3 Standard subscription fees and terms will apply from the date of upgrade.
6. Data During and After Trial
6.1 You retain ownership of any data you input into the platform during the Free Trial.
6.2 If you do not upgrade:
- Your access to the platform will be restricted or suspended at the end of the Free Trial.
- Budgetly may retain your data for a limited period in accordance with its Privacy Policy and data retention policies.
6.3 Budgetly may delete Free Trial data after a reasonable period if no upgrade occurs.
7. Acceptable Use
7.1 You agree not to:
- Use the Free Trial for unlawful purposes
- Attempt to reverse engineer, copy or replicate the platform
- Share login access outside your organisation
- Use the Free Trial to evaluate Budgetly for competitive or benchmarking purposes without consent
7.2 Budgetly may suspend or terminate Free Trial access immediately if misuse is suspected.
8. No Financial Advice
8.1 Budgetly does not provide financial, legal, taxation or accounting advice.
8.2 The Free Trial platform is provided for evaluation purposes only.
9. Disclaimer of Warranties
9.1 The Free Trial is provided on an "as is" and "as available" basis.
9.2 To the maximum extent permitted by law, Budgetly disclaims all warranties in relation to the Free Trial, including fitness for purpose and uninterrupted access.
9.3 Nothing in these Free Trial Terms excludes any rights under the Australian Consumer Law that cannot lawfully be excluded.
10. Limitation of Liability
10.1 To the maximum extent permitted by law, Budgetly’s liability in connection with the Free Trial is limited to AUD $100.
10.2 Budgetly is not liable for:
- Indirect or consequential loss
- Loss of profits
- Loss of business opportunity
- Data loss resulting from non-upgrade
11. Trial Abuse & Cancellation
11.1 Budgetly reserves the right to:
- Cancel a Free Trial at any time
- Refuse access
- Prevent repeat registrations
- Investigate suspected misuse
12. Changes to These Terms
12.1 Budgetly may update these Free Trial Terms at any time.
12.2 Continued use of the Free Trial constitutes acceptance of any updated terms.
13. Governing Law
13.1 These Free Trial Terms are governed by the laws of New South Wales, Australia.
13.2 The parties submit to the exclusive jurisdiction of the courts of New South Wales.
